Mr. Boyken provides project coordination and comprehensive construction
cost, value and progress evaluations on numerous major construction
projects. He feels strongly that the Program and Project Managers must
work with both the design team and the owner toward the common goal
of achieving design solutions that are functional, efficient, and cost
effective. As Chairman and CEO of Boyken International, Inc., he has
the ultimate responsibility for the technical review and quality assurance
of the firm’s work. He also serves as an expert witness for clients
when the firm is engaged for Litigation Support assignments.
Mr. Boyken has been instrumental in working with clients who have
critical project problems, not only finding solutions, but also helping
owners with the implementation of these solutions. His work as a Contractor,
Project Engineer, Cost Analyst and Turn-Around Specialist uniquely qualifies
him, and the firm, to advise clients on projects with foreseeable problematic
issues and to resolve the conflicts before they become a hindrance to
the project.
Mr. Boyken has also provided expert witness testimony regarding project
costs, defective construction, project means and methods, and costs
for foreclosed or bankrupt properties in cases involving airports, apartments,
office buildings and sports arenas. He has led the firm in the development
of computer video and animation graphics as trial aids and was instrumental
in achieving industry recognition of the firm’s current success.

Significant programs for which Mr. Boyken and his firm have
provided valuable and relevant expertise include, among others:
The Venetian Hotel & Casino • Las
Vegas, Nevada: Mr. Boyken led the team in investigating construction
defects and developing the cost analysis for the claims defense. He
is leading the Boyken research team to defend the $150 million claim
and assisting in the preparation of the $30 million counter claim.
Mr. Boyken is also testifying in the change order arbitration for
this project.
Newlands Office Building • Bethesda, Maryland: Mr.
Boyken was retained to assist with the project close-out including the
resolution of change orders, incomplete work, and claims against the
contractor. A final agreement was successfully negotiated for all but
one issue which was arbitrated.
The Bay Resort • Providenciales, Turks & Caicos Islands,
British West Indies: Mr. Boyken served as an expert witness
and led the project litigation support team to its successful conclusion.
This project included the review and analysis of contract documents
and establishing the necessary support documentation. The Boyken team
worked with the client to develop the support documentation for change
orders recovering 90% of the claimed costs. The team provided scheduling
information, analysis, damage calculations and testimony demonstrating
the owner’s delays to the contractor. The resulting verdict
indicated the team’s overwhelming success.
Denver International Airport • Denver,
Colorado: Mr. Boyken was initially retained on one of 12
national Arbitrators for the Dispute Resolution program, resulting
in this mega-project having very few claims. Mr. Boyken later served
as an expert witness for the claim between the Airport Authority and
the design team. He provided testimony based on his experience on
numerous large projects in the US, Caribbean, and England.
Job Corps Center • Charleston, West
Virginia: A dispute arose between the general contractor
and the earth work contractor for changes in conditions during the
construction. This assignment included a review of project records,
schedules, change orders and an analysis of the earth and rock quantities
for construction if the facility were on a different site. The case
was resolved favorable for our client.
